The Necessity of Probate

People have a will done so that they can decide what will be done with their property and possessions when they are gone.  They can choose who gets what and what will be done with the money they leave behind.  Before the property of the deceased can be distributed legally, probate must be done.  

This process is done as a way to give those who object to the will their time to state their case.  This is also when other possibilities arise, like another will was made later, maybe at the time of the making of the will the deceased was mentally incompetent or the will is a fraud. Maybe the will was not signed or someone feels the will is a forgery. There is also the chance for other claims which can impact the gifts the beneficiaries would receive.  

In those cases where the estate is smaller, there is a procedure that is less formal but still supervised by a probate court.  When the court finds that the will is valid and there are no objections, the property can then be legally distributed. Probate is done to protect everyone involved and although it may take time, it is the best way to handle those final wishes that someone left behind. 

Major recall on hip replacement devices

The world of health has suffered a shocking revelation as DePuy, a subsidiary firm of the health giant Johnson & Johnson, ordered a major recall of all its hip replacement devices.

Hip replacement is a tricky surgery, as I’m sure you imagine. It’s a very sensitive area of the human body and crucial to motion and for people to be able to live a normal life. There is some debate in the Medicine world about the best materials and best way of going about doing a hip replacement surgery. In laymen’s terms, the hip joint is your average ball and socket joint. The thigh bone ends in a ball that fits into a socket in the hip. Some medical experts claim that having both the ball and the socket made out of metal is a better combination as the materials are better lubricated and the joint performs better. Others believe that a combination of a plastic socket with a metal ball is better, since it reduced the amount of debris cause by the friction between the two parts. Metal debris in the body, as you may understand, is not a good thing. Usually patients can deal with it and not require any additional treatment for it, but in some cases a second surgery is required to handle the swelling and inflammation caused by the debris.

The DePuy asr hip recalls occurred because the percentage of patients developing said complications was much larger than the normal rate, averaging one out of every eight cases. There are reports that the company knew about this situation for some time but only acted upon in now, which also triggered a class action lawsuit against DePuy.

Society Under a Microscope

There was a time when a person could get by in life without anyone ever knowing a thing about them. People who had criminal infractions in one place could move to another and live happy and normal lives, without anyone ever being wise to what they had done. This is not true anymore. Today, no matter what you have done, whether it was receiving a traffic ticket, or being foreclosed on because you couldn’t pay your mortgage, someone is bound to find out. This is because we are living in the age of information, where all sorts of information is right at our fingertips. There are even cameras installed on traffic lights that take a picture of your license plate when you disobey a traffic law. In addition, the internet offers end users just like you and me the ability to do a criminal and public records lookup and find out anything we want to about our neighbor, employer, boyfriend, or co-worker. In some cases this is a blessing, especially when it comes to things like protecting our children from predators. However, there are some people that say it is a direct violation of our civil rights. Some people feel that we should be entitled to our secrets, as we once were. Other people are selective in their beliefs. On one hand they love the information they are able to obtain, on the other hand they don’t want anything being revealed about them.

If a person has had financial difficulties or even a past history of drug abuse, is it our right as a society to know about these things even if they would never directly affect us? There are several schools of thought on this and most people base their opinions on a self serving agenda. The people who have been victimized by others tend to agree with the many different methods of looking into one’s past, while the people who have made mistakes they wish would go away are haunted by this. It seems the only thing we can do as a society is strive to understand that a person’s past does not necessarily define who they are today. However, these new informational systems may just be the determining factor in the way people shape their future behaviors.

Getting Married in Florida

There are a few things people wanting to be married in the state of Florida must consider. First, both the bride and groom must be at or above the age of 18 which is considered the legal age in Florida. You do not have to live in Florida to be married in Florida; additionally you can apply for a marriage license in any county, no matter where you may live, even if you are a Florida resident. Both the bride and groom must have current and valid photo identification, either from whatever state they reside in, or from a government agency such as the military. Birth certificates, social security cards, and green cards are not acceptable as valid forms of ID. However, US citizens must also present their social security card, in addition to photo ID. Non-US residents must provide their Alien Registration card, along with their Passport, Driver’s License, or any other documentation that proves their identity. In addition, people may be asked to provide additional documentation such as pay check stubs or W2 forms. Also note, expired ID cards or Driver’s Licenses will not be accepted. The typical marriage licnese fee is about $94 dollars and there is almost always a three day waiting period before the couple are permitted to marry. There are a couple of exceptions to the waiting period and they are as follows. If a couple can provide proof that they are not Florida residents, or if the couple has completed a pre-marital course, and can provide a copy of the certificates. If either the man or woman has been married previously, that person will need to provide proof that the first marriage has been legally terminated. If the divorce record has been lost or the person does not have a copy of it, for whatever reason, it can be obtained through florida divorce records online and printed out. There is no blood test required in Florida in order for a couple to be married, as there is in some other states. Getting married should be a pleasant experience but unfortunately there are certain steps in the legal process that have to be taken.

How Air Brakes Work on a Truck

Because a runaway truck could result in a much worse outcome than a car with a brake failure, tractor-trailers are designed to use air brakes. While traditional vehicles rely on hydraulic fluid for the proper functioning of their braking system, air brakes rely on the air that surrounds us all. The theory is that there is less potential for failure of the system if you don’t have any fluid to leak. As an additional safety feature, air brakes will lock up and stop the truck immediately if they fail as opposed to hydraulic brakes that don’t work at all during a failure.

Truck Air Brakes

The air brakes on large trucks operate on the triple-valve principle where air pressure must build up inside the pipes to release the brakes. Most systems feature a graduated release system where a partial build up will result in a proportionate release of the brakes. Those odd squeaking and hissing noises that you hear coming from a parked truck are a result of the operation of the air brakes. The squeaking occurs as air is released from the brakes, and the hissing comes from the bypass safety valves maintaining the air pressure at the correct pressure. Air brakes are also the reason why trucks must usually sit for a few minutes when first started so that the brake pressure can build.

The Basic Principle

George Westinghouse invented air brakes in 1869 for the railroad industry, and their basic operation remains the same to this day. Westinghouse’s triple-valve air brake system consists of three basic functions. The first step is charging. The system must be brought up to pressure before the brakes can be released. The second step is when the brakes are applied. During application, air pressure drops and air flows back through the valve into the reservoir tanks. During the final release step, the pressure is again increased. Logically, this sounds backwards to most people who normally use hydraulic brakes. With a normal vehicle, you stop as apply more pressure. With air brakes, you stop as you reduce the pressure.

Brake Failure

While we often hear about problems with air brake systems, a total system failure is extremely rare. Most trucks are equipped with emergency air brakes in case the primary system fails, and some trucks also have an exhaust brake system that is powered by the engine instead of the air system. With all backup systems taken into consideration, it’s still possible for an accident to occur because of faulty brakes if proper maintenance is not performed.
